Legally? The guy on the bike is on the sidewalk so he's breaking the law. The truck driver might avoid blame as he might not have seen the cyclist. So yeah,it's not clear cut.
Logically speaking,the cyclist. He's where he shouldn't be and you should never assume a truck driver can see you. He's also in a position where he could safely stop and wait to make sure the trucker could see him before he ran in front of him.
