Unfortunately correct. Most news outlets are reporting the indictment as "first degree murder," but in Texas there's just "murder" and then "capital murder." This is obviously deserving of the latter charge, but I'm guessing the DA figured it'd be impossible to get a jury without some smooth brain hanging it because they don't want to lock the nigger up and throw away the key. He could in theory still get 99 years, but he'll probably parole out in 20. Hell, it wouldn't surpass me if they let him plea bargain down to aggravated assault with a deadly weapon and manslaughter, and just give him 20 without parole.
