The way I understand him is the tax man doesn't actually have you count tips, but just assumes a flat number and taxes based on that. So even if no one tips you, ever, you still had to pay taxes on the tips you didn't even get. I don't know how this works, but that sounds believable.

If a waitress makes under the standard deductible, they dont have to pay a penny though. That's the tax code. Regardless of how much of her income was tips, if she made under 13k, she doesnt owe anything.

First off...you are assuming just because the government says to do something that you "have to" do it. You said you have to pay these taxes...I'm saying you dont know the definition of have to then. I dont have to do shit that the government wants. Fear of an audit doesnt force me to submit to them.

Secondly, the money that was given to the waitress as a gift has absolutely nothing to do with her salary. It is not a tip...it is not her salary. You keep saying IRS requires tips to be reported, but a gift is not a tip. And a tip is not a gift. If she has already recieved 8% of her salary in tips, this 20 wouldnt count right?

From what I read, the company as a whole has to have 8% allocated and if not, everyone who makes tips makes up the difference. Which is gay as fuck. With a little bit of number fudging, they dont have to pay shit though.

But if she has already reached that 8%, and then accepts anything passed 8% as a gift, thus not reporting it, what are they taxing from the $20? Do you have an actual answer for that, or another faggy response?
