Sure, the court system tends to favor prosecutors, so (in theory anyway) whatever fundamental rights the defendant has must be carefully respected.

The fact that this ADA faggot decided to encroach on Kyle’s 5A multiple times even after being directly warned is the basic equivalent of schoolyard bullying, but with the additional jeopardy of life in prison.

Down here defendants are not. They can if they want to, but it isn't wise in most cases, because witnesses, defendants or not, get nervous and stressed - especially in a case of this magnitude. Kyle is too young to dissemble.

Under normal circumstances, it is inadvisable for the defendant to take the stand because whatever they say can only hurt their case. However, in this case, Kyle is presenting an affirmative defense; that is, the argument is "Yes I did everything I am accused of, but it was not against the law."

In cases like this, there are calculated risks to taking the stand, but in most cases like these there are advantages to testifying because it garners sympathy from the jury, and can even make it look like the prosecution is unfairly bullying him. And in this case, that's what happened -- it looked like the state was viciously pushing a kid around.
