Caught a snip of MSM this evening that said someone had requested a mistrial with prejudice, meaning charges cannot be refiled. Judge is considering it. When it becomes very obvious that there is no reasonable basis for charges having been brought, a mistrial can be declared by the judge. Let the civil suits begin! Que the slavering, trial lawyers.

The mistrial with prejudice is about the prosecutor violating very simple court rules. He tried to make Rittenhouse look like a liar because he enacted his right to silence. Then he brought up information the judge had excluded previously. The defense has brought up the notion that the prosecutor knows he has lost so he wants a mistrial so he can start over. If he is doing it intentionally, they can ask for a mistrial with prejudice so that he won't get that do-over.

I just watched the clip of the judge admonishing him. It looks like he knows he's lost and is grasping at straws either hoping to scrape out a win, or as you said, to get a mistrial and a chance to avoid mistakes. The state gets one shot to make a case against a citizen and it looks like they have spent it. Not familiar enough with WI or US law to know if prosecution can appeal a judge's mistrial with prejudice. Getting close to double jeopardy.

In almost all cases a mistrial is without prejudice. The prosecutor wasn't expecting to get called on his bad faith acts.

I was surprised to hear them add with prejudice. That indicated some serious BS from the prosecutor even bringing the case to trial.

I don't think he was surprised by it. He's playing for the libshit media. If he gets a mistrial instead of an acquittal, he can blame it on the judge. If he ends up fired for prosecutorial misconduct, he'll get a soft-landing job as a talking head on CNN or something, or a cushy book deal, just like the fuckheads that came before him (Comey, Clapper, etc). He's down with the cause, and is willing to sacrifice his career and integrity.
