I might be wrong, but here are the two things I believe.

A) she drove him while there was no riot - to clean up after one. Whether she knew there would be a riot that night is up for debate.

B) Kyle did not have the AR in the car. He picked it up from a friend later.

I'm sure any libtard's mom would eagerly drive someone to a riot/protest, already in progress even, all for virtue signaling points. She might even post it on social media for extra points.
