It's actually a political position. They were meant to settle arguments between the states; not make policy. Of course their entire history is precisely expanding their own power to create policy. Early on they basically declared themselves the supreme branch of government, and everyone went along with it. It's nowhere actually in the Constitution that they can decide whatever they want and no one can question it.
