The answer is two fold. Get rid of divorce. Marriage isn't really marriage if divorce is an option, outside of reasons of adultery.
Second, marriage should have never been a government concept and should have purely fallen under the institution of religion when state and religion separated, as baptism did. The government should not be doing anything on the basis of marriage much less moving people's money around. "Oh, you did this religious act, now you lose half your money." It's completely inappropriate for government to apply a liability to someone for having engaged in a religious practice, which marriage is.
100% agree, you make good points. Anyone who disagrees with you doesn't understand the first thing about family, marriage, the law, or religion.
Yet another reason to be Catholic, we've always condemned divorce, always, and Christ taught that divorce basically doesn't exit "What God has joined together, let no man put asunder", two become one flesh, until death do us part, etc. And when you think about what marriage actually is, it doesn't make any sense whatsoever to have divorce. If one of the spouses is out of control, you kick them out until they come back to their senses, but divorce itself doesn't exist. The contract is permanent until death of one of the spouses. A lot of people are living in adultery today for this very reason, especially divorced and "remarried" people, and they're going to Hell. I get some of you are not Christian, but you can't really reasonably argue divorce needs to exist because even ancient pagans didn't believe in it. Divorce has basically always been considered a cop-out name for adultery.
This directly impacts a woman being subordinate to her husband, and it is his right and authority as head of the family and marriage to corporeally punish her when she steps way out of line (within reason, don't break her jaw), just like you have a right to spank your children because they are subordinate to you. But now, you can't even correct your wife without fear she is going to call the cops and steal all your stuff because of "irreconcilable" differences. Why is it that women initiate 80% of divorce and men are not allowed to corporeally admonish their wives when they step out of line? Because divorce has been "legalized." It creates so many problems. Our society would be so much healthier without it if the government wasn't artificially and practically stripping the authoritative rights of husbands and fathers.
Idk about getting rid of divorce, but it certainly shouldn't be incentivised. Also, as you say, it should be purely a private contractual matter (like it used to be). Not some blank check a politician or judge can rewrite at their whim.
