It’s not hard to win. Most people and cops don’t know this but it is a felony for police to use their emergency lights when there is no emergency. If a cop flips on the lights to pull you over for speeding then they committed a felony. Nobody does the homework to learn this because they are too busy freaking out about how to get themselves off of the ticket. It’s easy if you never sign it. Then establish that you’re traveling in your personal conveyance. Fuck cops and courts. They are full of shit.
From the videos I've seen, not 'promising to appear' (signing) usually results in them not letting you disappear. Meaning, they use any means to secure you and take you to a secure location known as jail.
Yep. You can get a huge settlement when they violate your rights like that. Them taking you to jail is the best case scenario. You can also sign and right under duress or some shit like that if you’re too chicken to not sign it.
If you don’t sign it then all you do is return the presentment to the court and state that you do not wish to contract with them. That promise to appear signature is really you contracting with them and their rules. No signature, no contract. That’s why they are so hell bent on getting you to sign. They have no power over you with their statutes and codes if you refuse to contract with them.
Them taking you to jail is the best case scenario.
Funnily enough, that was the best case scenario. I'm not really in the market for huge settlements though, and my experience, they have quite a bit of power over you.
