At first I'm shocked at this because it's clearly wrong but when you read the article and you understand how the constitutional scholars like cavanaugh and others think you know that what they're looking for is the right case to address the issue of seizure without any hearing directly. This case was a case about when the hearing should take place after the seizure. That's what gorsuch is referring to in his consenting opinion. Now personally I think the court should be more proactive and rule beyond the existing case in front of them but we know these conservative justices are against active judiciaries and so they're not going to do that. They need somebody to bring up a case that says it's flatly unconstitutional for items that are not related to a crime to be seized by the government without a trial and this case did not do that. Still it sucks that this nonsense stays on the books longer than it should. Frankly the real main problem was when police officers started doing this and police departments started doing this and they started doing it in the eighties and there was a lot of drug trafficking and the drug traffickers had so much money that they could often win in court and they wouldn't lose anything and people had the misguided opinion that if they seize their boats and seized their stuff ahead of time that it would somehow make them pay even if they won in court. So that's when all this stuff started is in the 1980s during the cocaine hay days when all these giant cigarette boats and stuff were being used by the drug smugglers as you see in TV shows like Miami vice and others.

I do hope somebody does bring a case that directly addresses the issue and I'm really surprised that no one has done so because these seizures have been going on for over 10 years now and I just can't believe someone hasn't directly challenged this in court on a constitutional ground saying the stuff can't be seized in the first place not worrying about when the timing for the hearing is.
