To better your scenario. The car runs but doesn't get the gas mileage that the seller claimed, relying on test results from a 3rd party, but you didn't even care and actually loved the car despite the lower gas mileage. Would even buy the car, again if given the opportunity. But the State stepped in and prosecuted the seller because they got the gas mileage estimate wrong.
