if a law banned its use then how trump can override it since he hasnt even taking office yet? can the executive override laws?

Trump, for all practical purposes IS the President, the "Inauguration" is simply a formality.

Trump has BEEN the President since Jan.01,2025.

Nope, that's not true. The president-elect doesn't have any official powers until they are sworn in on Inauguration Day. The 20th Amendment to the U.S. Constitution clearly states that the terms of the president and vice president end at noon on January 20th, and the new terms begin at that time. Until then, the outgoing president retains all the powers and responsibilities of the office2.

So, while the president-elect can prepare and plan for their upcoming term, they can't take any official actions or make decisions until they take the oath of office

Fyi the executive branch enforces the laws the congress created. The executive branch declines to enforce all kinds of laws. Drug possession, illegal immigration, etc..
