By what authority did the constitution replace the articles of confederation? Lysander spooner said "this is all because of the constitution or the constitution failed to prevent it"
The constitution was ratified by the original 13 colonies that were following the articles of confederation. They agreed to end the articles of confederation and becomes states united in a union.
Not entirely, there was recognition that the articles of confederation were inadequate to govern the growing territories and changes had to be made. Was there coersion during the process? Perhaps for some, but not all, politics works that way. However it occurred, the eventual solution to the growing inadequacies of the articles of confederation ultimately resulted in the creation and implementation of the US Constitution.
They weren't supposed to be replacing the articles yet they did and yes they illegally forced rhode island to ratify. We'd bw way better off with the articles
I think the authors intended for the federal government that was created by the constitution was supposed to remain small with checks and balances and never envisioned the bloated monstrosity that the federal government has become today. The articles of confederation wouldn’t have allowed this but it also wouldn't be able to cope with, operate peacefully, and fairly, with the growth of the territories. It would have been chaos, it was already showing those signs with small rebellions occurring. The rules of the articles weren’t followed but they also weren’t working either so something had to change.
Constitution and Confederacy were just the opinions of lawyers and politicians, backed by a gun. America was supposed to be the land of the free. USA is not and never was about freedom. Stop pretending.
It's like saying "By what authority does a book replace it's rough draft?". "By what authority does a blueprint replace a drawing in the back of a napkin"? In the case of the Constitution, the authority is the ratification by the states.
The Constitugion is legitimized by the fact that it was ratified by all the states that previously ratified the Articles of Confederation.
The articles required all 13 to ratify they couldn't get it and illegally changed it to 9 to ratify THEN and only after illegally ratifying did all 13 the rest ratify because they were coerced. Its illegal!
