He's wrong. It's not that you get a $1k fine for something that is illegal in all 50 states. It's that you get a $1k fine for anything that is illegal in even one state.

For example, billboards are illegal in Hawaii and have been since 1920, so if you do anything with a billboard, that is a $1k fine.

This is only for automated SMS campaigns where a company is sending out text messages in bulk. This is not for individual customers who send Hitler memes to their friends.

T Mobile fining people for ToS violations is illegal. Not because of the 1st Amendment, but because it's illegal to fine people in a way that's not meant to recoup damages.

For example, you can be fined for paying late or to have your service restored because your lack of payment causes a (very small) harm or it takes work to restore service. So, they can fine you for these things. But, they can't fine you because you simply broke one of their rules. That is illegal.
